After reviewing a report filed by the Oklahoma Bureau of Investigation, District Attorney Brian Hermanson concluded that an officer involved in a shoot out May 27, acted appropriately.
After a police pursuit, a vehicle with three people stopped and one of the suspects, Larry Durbin, exited the vehicle and began firing at the Ponca City Police officer.
The officer returned fire.
Hermanson wrote in his letter to the Ponca City Police Chief Don Bohon, the officer had every right to protect himself and indeed a duty to use what force was necessary to protect the public.
Durbin is being held on a $10 million bond with eight charges, including shooting with intent, against him.
